Acceptable Use Policy

Brieva sends email on behalf of many customers through shared infrastructure. A single bad actor can damage deliverability for everyone. This Acceptable Use Policy ("AUP") sets the rules: it is binding on every customer alongside the Terms of Service.

1. Lists must be opt-in

You may only send to subscribers who have explicitly opted in to receive your newsletter on this topic. Double opt-in (a confirmation email) is enforced by Brieva and cannot be disabled. You must be able to produce evidence of consent — timestamp, source, and the wording of what the subscriber agreed to — on request.

You may not upload, import, sync or otherwise add to Brieva:

  • Purchased, rented, leased, traded, scraped, harvested or appended lists, in whole or in part, however described by the seller.
  • Lists assembled from publicly available sources (LinkedIn, websites, WHOIS, conference attendee dumps, etc.) without an explicit prior opt-in to your newsletter.
  • Contacts collected for a different product, brand, list or purpose — even your own — without a fresh, recorded opt-in to this newsletter.
  • “Co-registration”, “pre-checked-box”, “negative-consent” or bundled-with-another-form acquisitions.

Spam traps and honeypots. You may not knowingly import any address you have reason to believe is a spam trap or honeypot (including role-account dumps, abandoned addresses, or seeded lists). Hits on known spam trap networks can destroy deliverability for every Brieva customer and will result in immediate suspension under “Enforcement” below.

2. Identify yourself honestly

From-name, from-domain, subject line, preview text and content must accurately represent who you are and what the email is about. No false header fields, no impersonation of another brand or person, no fake personal-correspondence cues.

Prohibited subject-line patterns include (without limitation):

  • Fake reply or forward prefixes: RE:, FWD:,Re: our chat, when there was no prior exchange.
  • Fake personal openings: You forgot this,About your order, Your invoice attached, when there is no order, invoice or relationship.
  • Fake delivery / transactional / system notices: Delivery failed,Account suspended, Password reset,Action required, on marketing content.
  • Impersonation of another service: subject lines styled to look like they came from a bank, courier, government agency, social platform or other brand.
  • All-caps shouting, repeated punctuation (!!!), or symbol clusters designed to evade spam filters.
  • Misleading scarcity or financial claims that cannot be substantiated.

3. Prohibited content

You may not use Brieva to send, distribute or link to:

  • Spam, scams, phishing, malware, or credential-harvesting content.
  • Illegal content under New Zealand law or the law of the recipient.
  • Content that infringes copyright or other intellectual property rights.
  • Content promoting violence, harassment, or discrimination.
  • Sexually explicit content, gambling, MLM/get-rich-quick schemes.
  • Unregulated promotion of regulated products (financial products, prescription drugs, firearms, tobacco, cannabis).
  • Misinformation about elections, public health, or scientific consensus presented as factual reporting.

4. Technical abuse

You may not attempt to overload the service, reverse-engineer it, evade rate or plan limits, scrape data from it, probe it for vulnerabilities without our written permission, or attempt to access another tenant's data. Brieva enforces strict tenant isolation; testing it without authorisation is a violation.

5. Reputation thresholds

We monitor per-newsletter bounce and complaint rates from Amazon SES feedback. Sends are paused automatically when a newsletter exceeds:

  • Bounce rate above 5% (warning at 3%).
  • Complaint rate above 0.08% (warning at 0.05%).

These are well inside Amazon's account-level limits and exist to protect every Brieva customer's deliverability. To resume sending after an auto-pause you must clean the affected list (remove old or unconsented contacts) before re-enabling the newsletter.

6. Handling complaints and unsubscribes

You must process unsubscribes promptly (Brieva does this automatically). You must not re-add an address that has unsubscribed, bounced repeatedly, or complained, unless that person opts in again of their own initiative. Suppression lists are maintained per newsletter and cannot be cleared.

7. Enforcement

Brieva may, with or without notice, pause sends, suspend an account, remove content, or terminate an account that violates this AUP. We may report criminal violations to law enforcement. Repeat or egregious violations result in permanent termination without refund.

8. Reporting abuse

Recipients who believe a Brieva-sent newsletter violates this AUP should email skene@ez-ai.nz with the message and a brief description of the issue.
